No. As a consumer, you do not have a right of withdrawal (fourteen-day reflection period) for our Dutch auctions.
Why not?
The law makes an exception to the right of withdrawal for agreements concluded during a public auction. A public auction occurs when lots are offered through a transparent, competitive bidding process led by an auctioneer to consumers who are personally present or have the opportunity to be present, and the winning bidder commits to purchasing the lot.
Our auctions meet these criteria. You can place your bid online, but you can also choose to place your bid in person in front of the auctioneer at our office. This option is available to every registered bidder. Because you have this choice, it is considered a public auction, and the right of withdrawal does not apply.
I want to place my bid in person, how does that work?
Register no later than 2 business days before the auction closes by emailing aanmelden@troostwijkauctions.com with the auction number and the relevant lot number. We will inform you when you can attend. You place your bid in the presence of the auctioneer; it will be processed in the same way as an online bid.
What about bankruptcy auctions?
There is also no right of withdrawal for sales from bankruptcy or other judicial sales.
What rights do still apply?
The absence of a right of withdrawal only means that you cannot undo a purchase without giving a reason. Your other rights and the General Terms and Conditions for Buyers remain fully applicable. Therefore, always make use of the viewing day/inspection to assess a lot in advance.
